Terms of Sales

PREAMBLE

These general conditions of sale govern the contractual relationship between PHILIPPE ZORZETTO - Creator and Distributor of the products - and its consumer customers (hereinafter Customer(s)), who acknowledge having read them, before placing an order, and expressly declare to accept them without reservation before any order. The term "consumer" refers to a natural person placing an order that does not fall within his commercial or liberal professional activity.

The terms and conditions and prices are subject to change and update at any time. The general conditions as well as the price conditions applicable to the order of a product on the Site are those in force on the day of the order.

Only the French version of these general conditions of sale is opposable to PHILIPPE ZORZETTO. If one of the provisions hereof were or became null or unenforceable, the validity of the other provisions would not be affected. The null or unenforceable provision would then be replaced by the applicable legal provisions.

PRODUCTS

The information on the products and their characteristics correspond to a definition at the time of the online publication or updates of the various pages of the site: they are given for information only. If errors have been introduced, under no circumstances can PHILIPPE ZORZETTO be held liable.

The photographs illustrating the products do not enter into the contractual field. In particular, the tone of the images depending on the settings and resolutions of the Customers' equipment, PHILIPPE ZORZETTO is not responsible for the interpretation of a displayed color that does not correspond to the product actually delivered. The sale cannot therefore be subject to cancellation, outside the conditions of return or withdrawal provided for in article 6 hereof.

REGISTRATION AND ORDER

Registration on the Site is mandatory before placing an order. Registration on our site is free and you can cancel it at any time. The information given by the Customer when taking the order commits the latter: in the event of an error in the wording of the recipient's contact details, PHILIPPE ZORZETTO cannot be held responsible for the impossibility in which it could be to deliver the product. .

Process of the sale: The product(s) chosen by the Customer is/are placed in his basket. The Customer then chooses the delivery option and clicks on the “next step” button. He then enters/confirms his address and clicks on the “next step” button. He confirms his delivery method, accepts the general conditions of sale by ticking the dedicated box and then clicks on the “next” button. He chooses the price payment option. In the case of payment by check or bank transfer, the Customer must press the "I confirm my order" button.

Automatic registration systems are considered proof of the nature, content and date of the order. PHILIPPE ZORZETTO confirms the acceptance of his order to the Customer at the email address that he will have communicated when opening his customer account. The sale will not be concluded until the confirmation of the order, PHILIPPE ZORZETTO reserving the right to cancel any order from a Customer with whom there is a dispute, in particular relating to the payment of a previous order.

PRICES AND DELIVERY COSTS

The price is expressed in euros, all taxes included for sales delivered in France, excluding taxes for sales delivered outside France.

The price indicated on the product sheets does not include transport. Shipping costs are automatically calculated based on the total weight of the goods ordered, the destination and the shipping option chosen. They are added to the price of the products.

For deliveries to the rest of the European Union and the world other than Metropolitan France, Corsica and Monaco, the conditions relating to the "Guide Courrier - Parcels International et Outre-mer" will apply. In addition, for deliveries outside mainland France, the Customer agrees to pay all costs and taxes that may be due under the laws of the country of receipt of the order for the importation of products. PHILIPPE ZORZETTO cannot be held responsible in the event of non-payment by the Customer of said costs and taxes.

For reasons of unavailability, an order could be delivered in several installments to the Customer. The customer only pays for one delivery. If the Customer wishes 2 places of delivery, he places 2 orders, with the related delivery costs.

PAYMENT

The Customer can pay by credit card.

Payment by secure credit card allows you to pay via a bank server in a secure environment. (SSL). Your credit card number is therefore directed to the bank's servers, your payment is made directly to a bank in a secure environment without going through the store's server, a guarantee that is all the more important as your numbers are known. only from our banking partner.

Whatever the method of payment chosen by the Customer, any payment will only be considered final after effective and complete collection of the sums. We do not bear the costs relating to payments from third countries. In the event of refusal of the transaction by the banking centers, the order will be automatically canceled and the Customer notified by e-mail. You agree to receive your invoices exclusively in electronic form.

TRANSPORT AND DELIVERY TIMES

PHILIPPE ZORZETTO undertakes to make every effort to process your orders as soon as possible. However, delivery times are given for information only and depend on the delivery method chosen by the Customer. They may in particular be extended in the event of force majeure, fortuitous event as defined by French case law or by a foreign cause, in particular a fault which would be attributable to the Customer. The following are considered as cases of force majeure releasing the seller from his obligation to deliver: war, riot, fire, strikes, accidents and the impossibility of obtaining supplies. If the impediment lasts more than four (4) weeks, each party will have the right to terminate the contract as of right, excluding any damages.

OPTIONS

The products are generally delivered by Colissimo to the address indicated by the Customer and according to his choice, in the order and only in the geographical areas served. The Customer can choose his own carrier but must first inform PHILIPPE ZORZETTO; his file will be configured taking into account the elements provided by the Customer. The amount of transport will be due by the Customer, who will deal directly with the carrier of his choice for the payment of all costs. PHILIPPE ZORZETTO will in no way be held responsible for the payment of fees.

RISK TRANSFER

The risks are borne by the Customer from the moment the products leave the seller's premises. PHILIPPE ZORZETTO cannot be held liable for damage or late delivery.

CONTROL

Always check your package upon arrival. You have a period of 48 hours to make any reservations with the carrier in the event of missing items or damage. In case of damage during transport, the Customer must report it at the time of delivery, if necessary refuse the latter.

If the package is accepted by the Customer, he must send his complaint to the management of LA POSTE or the carrier, to obtain compensation.

RETRACTATION AND RETURNS

In the event of a handling error at the time of the order, or simply of renouncing an order before the shipment of the products, the Customer must make his request by mail or email to Customer Service whose address is specified at section 8; the error duly noted, the refund will be made without delay.

In accordance with the Consumer Code, the Customer has a right of withdrawal within 14 clear days from the date of delivery of the products. This right of withdrawal is valid exclusively for sales via the Site (sales in shops are excluded), excluding periods of sales and private sales. Custom-made products are excluded from the right of withdrawal as well as products that have been damaged or used. The Customer must indicate his wish to withdraw within the time limit set to Customer Service, the address of which is specified in Article 8. Within 14 days of notification by the Customer of his wish to exercise his right of withdrawal, the Customer must return the products, in their original packaging, the return costs being entirely at his expense.

In the event of a defect in your product, you must contact the Customer Service department designated in article 8. Once the defect has been duly noted by both parties, a return authorization number will be issued to you by our sales department; without authorization, any return will be refused. Return costs are the responsibility of the Customer. In case of out of stock of the model requested during the return, a credit will be granted to the Customer.

WARRANTY AND LIABILITY

The consumer benefits from the legal provisions relating to the guarantee of hidden defects and defective products according to French law. The liability of SARL PHILIPPE ZORZETTO shall, in any event, be limited to the amount of the order.

APPLICABLE LAW AND DISPUTES

Sales via the Site are deemed to be concluded in France, no solicitation being made to Customers located outside of French territory. These General Conditions are therefore subject to French law. In the event of a dispute, the Customer will first contact PHILIPPE ZORZETTO to seek an amicable solution.
